‘Nipplegate’ Incident Gets Fine 4 years later overturned

Yesterday July 21st the “Nipplegate” scandal at the 2004 Super bowl got the fine of $550,000 tossed out of court, ruling that the Federal Communications Commission “acted arbitrarily and capriciously” in penalizing the network for a “fleeting image of nudity.”

The Bush administration are appealing against the case and the Supreme Court agreed to hear it.

Now I am sorry to say this people and all who read this, this should have never gone to court in the first place, could have been a waste of public money which could have been put to better medical care or education.

Both of these are needed desperately in America, and me from the UK believe this could have been more beneficial..

Instead the FCC (I could come up with a better names for them using expletives) waste their time on this.

Was the ‘wardrobe malfunction’ an accident, maybe? maybe not?

But if you remember and you can check it on youtube still, you can’t even see her nipple unless you have microscopic eyes because it is covered with a piercing, not a little ring or stud but a F*cking massive jewelery piece.

It wasn’t like the artist was doing coke on stage or whipping their breasts, penis out.

Why are people so prudish, don’t people have sex anymore?!!

The hype behind this was to overshadow the Iraq war, SIMPLY AS THAT

Look at all the violence and wasted money spent on that and still is, and what benefit do the American people get out of it

But instead parents (probably from the Bible Belt, I suppose), Bill O’Reilly, get upset at seeing Janet Jacksons Nipple, which I hasten to add, most people with a bit of imagination would know what Janet Jackson breasts look like. The famous Rolling stone cover and her videos are sexually evocative.

Plus how many times have people seen Pamela Anderson’s Nipples, but that’s alright she used to be a playboy model..

Double Standards!

So instead of suing CBS why don’t the FCC and the US population sue the BUSH administration for misguiding the American people to fund the war (or stabilizing) against/with Iraq.

For all the money spent on that war what benefit has the US people received nothing but poverty and if victims of theirs sons, fathers, mothers who have been killed in action.

The decision is another blow to the aggressive indecency policy the FCC has adopted and enforced under chairman Kevin J. Martin and throws the agency’s indecency enforcement into further disarray. Last spring, a different federal appeals court struck down FCC rules on so-called “fleeting expletives.” The Bush administration appealed and the Supreme Court is scheduled to hear the case in the fall.

With that and the Jackson case tied up in court, the FCC’s indecency rules have been in legal limbo, forcing commissioners to let thousands of complaints back up.

The three-judge panel of the U.S. 3rd Circuit Court of Appeals in Philadelphia ruled in the Jackson case that the FCC departed from a decades-old policy that brief and isolated incidents, including impromptu expletives, did not violate rules designed to keep children from seeing indecent material broadcast between 6 a.m. and 10 p.m. The panel also found that CBS was not liable for the incident because Jackson and fellow performer Justin Timberlake, who pulled off part of Jackson’s costume to reveal her breast at the end of their performance, were independent contractors, not network employees.

“The airing of scripted indecency or indecent material in pre-recorded programming would likely show recklessness, or may even constitute evidence of actual knowledge or intent,” the judges wrote. “But when unscripted indecent material occurs during a live or spontaneous broadcast, as it did here, the FCC should show that the broadcaster was, at minimum, reckless in causing the indecent material to be transmitted over public airwaves.”

The FCC argued that CBS was reckless in allowing the incident to occur. But the judges sided with CBS, which had argued the incident was unscripted and that the network had tried to prevent it, including “numerous script reviews and revisions,” “several wardrobe checks” and a five-second audio delay of the broadcast. CBS said video delay technology was not available at the time.

CBS said in a written statement this morning that it was “gratified” by the decision and hoped it would lead the FCC to moderate its indecency enforcement.

“This is an important win for the entire broadcasting industry because it recognizes that there are rare instances, particularly during live programming, when it may not be possible to block unfortunate fleeting material, despite best efforts,” CBS said.

The FCC had no immediate comment.

The Jackson incident, which was described afterward as a “wardrobe malfunction,” triggered outrage among many viewers, who flooded the FCC with complaints. It led Congress to dramatically increase indecency fines, to $325,000 per station for an incident from $32,500.

The incident also led the FCC to crack down on indecency, including adopting a near zero-tolerance policy on the use of certain expletives, even isolated, unscripted uses. The broadcast networks joined together to challenge that policy and last year the U.S. 2nd Circuit Court of Appeals in New York struck down that policy on similar reasons that it was an “arbitrary and capricious” diversion from longstanding FCC policy.

Justice was correct in this case and it is now for people to start reviewing what really is messing up America’s youth and society and it certainly ain’t the effect of Janet Jackson’s nipple, I assure you.

It is a certain BUSH and not the one you get pleasure out of having sex with..
